As a participant in the RCCA Forums, you agree to abide by the following terms and conditions as well as the RCCA By-laws and the terms and conditions, legal notices, and privacy statements applicable to all Motorsports Authentics websites, which may be accessed via the hyperlinks at the bottom of this page (collectively, the “Terms”). By using the RCCA Forums, you signify your acceptance of the Terms. If you do not agree with any of the Terms, do not use or otherwise participate in the RCCA Forums. RCCA reserves the right, in its sole discretion, to modify, alter or otherwise update the Terms at any time. Changes and/or modifications shall be effective immediately upon posting on the RCCA Website (the “Site”; the “Site” and the RCCA Forums are collectively referred to below as the “Service”). Please review the Terms periodically. Your continued use of the Service following the posting of changes and/or modifications constitutes your acceptance of any such changes and modifications. RCCA reserves the right to terminate your access to the Service immediately at any time for any reason, including without limitation your violation of the Terms.
User Content
You are responsible for any content, messages, opinions, ideas, photos, images, videos, profiles or other information that you create, transmit or display on or through the Service (collectively, “User Content”). By transmitting or displaying User Content on or through the Service, you grant RCCA and its affiliates an irrevocable, perpetual, non-exclusive, worldwide right and license to use, reproduce, publicly perform, publicly display, distribute copies and create derivative works of the User Content in any media now known or hereafter devised, and to grant and authorize sublicenses under the foregoing right and license without any compensation to you. You represent and warrant that you own all rights (including copyrights and other intellectual property rights) in the User Content, or otherwise have the right to grant the foregoing right and license. You agree that RCCA may review, edit and delete any User Content which, in the sole judgment of RCCA, violates the Terms.
Prohibited Uses and Content
You agree not to use the Service in any way that may give rise to liability for RCCA, Motorsports Authentics, Inc., their respective affiliates, or their respective directors, officers, employees, agents, service providers, suppliers or licensors, including, without limitation, by creating, displaying or transmitting on or through the Service any content that may violate any rights of others or that may give rise to any liability for anyone other than yourself.
RCCA reserves the right to determine what content or use is prohibited under the Terms. The following is a non-exhaustive list of examples of prohibited content and uses:
• Offensive or objectionable content or use, such as content promoting racism, bigotry, hatred, harassment or physical harm of any kind against any group or individual or containing profanity, nudity, pornography, or other sexually-explicit or objectionable materials;
• Junk mail, chain letters, or unsolicited mass e-mails or spam;
• False or misleading content, or any content promoting illegal activities or abusive, threatening, obscene, defamatory or libelous conduct;
• Content that infringes or violates any third party’s rights, including without limitation, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, e-mail address, physical address or phone number) and rights of publicity;
• Content promoting illegal or unauthorized copies of another person’s copyrighted work (such as pirated computer programs, music or video, links to any such pirated items and information to circumvent manufacturer-installed copy-protect devices);
• Content containing restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
• Content concerning the exploitation of people in a sexual or violent manner;
• Content that solicits personal information;
• Content providing instructional information about illegal activities (such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses);
• Content containing video, photographs, or images of another person without his or her permission (or in the case of a minor, the written permission of the minor’s legal guardian);
• Content promoting or soliciting involvement in or support of a political party or platform, religion, sect or culture;
• Content or use seeking unauthorized access to the Service, profiles, blogs, chat rooms, communities, account information, bulletins, or other aspects of the Service or soliciting passwords or personal identifying information for commercial or unlawful purposes;
• Content or use engaging in commercial activities or sales without RCCA’s prior written consent such as, without limitation, contest, sweepstakes, barter, sales advertising and pyramid schemes;
• Content or use soliciting gambling or engaging in any gambling or similar activity;
• Content containing any harmful, or disruptive creations, components or devices (such as viruses, time bombs, trojan horses, cancelbots, and worms);
• Content or use interfering with another user’s use of the Service; or
• Content referring to any website or URL that, in RCCA’s sole discretion, contains material inappropriate for the Service or prohibited by the letter or spirit of the Terms.
You must use the Service in a manner consistent with all applicable laws and regulations. Illegal or unauthorized uses of the Service are not permitted. Any access to or use of the Service or the computer systems used to provide the Service contrary to the Terms is expressly prohibited.
You shall not engage in advertising to, or solicitation of, other members through the Service to buy or sell any products or services. You shall not display in your user profile or other submitted content any telephone numbers or street addresses. You acknowledge that RCCA cannot monitor the off-line conduct of its members.
YOU REMAIN SOLELY RESPONSIBLE AND LIABLE FOR ANY CONTENT OR MATERIALS YOU POST ON THE SERVICE, INCLUDING WITHOUT LIMITATION ANY CONTENT TRANSMITTED IN THE PUBLIC AREAS OF THE SERVICE OR IN YOUR PRIVATE MESSAGES TO OTHER INDIVIDUALS. If you engage in any correspondence, business dealings, or promotional activity with any goods or services provider found on or through the Service, those matters are strictly between you and that goods or services provider. You acknowledge and agree that RCCA shall have no responsibility or liability for any loss or damage of any sort that you may incur as the result of any such dealings or as the result of the presence of any goods or services providers on the Service.
It is possible that other individuals (including “hackers” or unauthorized users) may post or transmit offensive or obscene materials on the Service and that you may be involuntarily exposed to such offensive and obscene materials. It may also be possible for others to obtain personal information about you due to your use of the Service, and to use such information to harass or injure you. RCCA does not approve of such unauthorized uses. By using the Service, you acknowledge and agree that RCCA is not responsible for any use or misuse of any personal information you disclose on the Service. Please carefully select the type of information that you post or display on the Service.
Subject to RCCA’s privacy policy, you understand and agree that RCCA has the right at all times to disclose information concerning any user of the Services. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity, solicitation of illegal activity or a court order or subpoena.
RCCA reserves the right, but has no obligation, to monitor communications and any disputes between you and other members, to remove or edit any material that in its sole opinion is inappropriate, offensive or objectionable, or violates or potentially violates any applicable law or the Terms. RCCA also reserves the right to terminate community privileges in appropriate circumstances. If you would like to report conduct you believe is in violation of the Terms, please send an email to RCCAinfo@motorsports-authentics.com containing the content that you wish to report. Reporting conduct as a violation does not mean it constitutes a violation, or that RCCA must or will take any action against such conduct or the user engaging in such conduct. In the event RCCA does take action against any reported conduct, it has no obligation to inform the person or persons reporting such conduct. It is a violation of the Terms to knowingly make a false report against another user, or to use the reporting process to harass or intimidate a user, or to encourage others to do so.
Limitation of Liability
Under no circumstances shall RCCA, Motorsports Authentics, Inc., or their respective affiliates and agents be responsible or liable for: (i) any incorrect or inaccurate content on or transmitted via the Service, regardless of the cause; (ii) any conduct, whether online or offline, of any user of the Service; (iii) any problems or technical malfunction of any telephone, cable or broadband lines, computer systems or software, servers or providers, computer equipment, failure of email, instant messaging services, or players on account of technical problems or traffic congestion on the Internet, including injury or damage to any person or computer related to or resulting from participating or downloading materials in connection with the Web and/ the Service; (iv) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or member communications; or (v) any loss or damage, including personal injury or death, resulting from anyone’s use of the Service, any content transmitted to or through the Service, or any interactions between users of the Service, whether online or offline. RCCA, Motorsports Authentics, Inc., and their respective affiliates and agents cannot guarantee and do not promise any specific results from use of the Service. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEITHER RCCA, MOTORSPORTS AUTHENTICS, INC., ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICE NOR THEIR RESPECTIVE AFFILIATES OR AGENTS IS OR SHALL BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING OUT OF YOUR ACCESS TO, OR USE OF, THE SERVICE, EVEN IF PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, THE SERVICE AND ITS CONTENTS ARE PROVIDED TO YOU “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

RCCA respects the rights of all copyright holders. In appropriate circumstances, RCCA reserves the right, but has no obligation, to terminate the access rights of subscribers and account holders who infringe the rights of copyright holders. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide RCCA with the following information (as required by the Digital Millennium Copyright Act):
• A physical or electronic signature of a person authorized to act on behalf of the owner of the allegedly infringed exclusive right;
• Identification of the allegedly infringed copyrighted work or works;
• Identification of the allegedly infringing material for which removal or disabling is requested, and information reasonably sufficient to locate the material;
